Mediation
A Practical Path to Resolution
Over the years, I’ve stood in nearly every corner of the courtroom. I’ve worked as a corporate litigator, a local prosecutor, and a plaintiff’s trial lawyer. I’ve clerked for federal judges at both the trial and appellate levels. I’ve tried cases to verdict in Oregon’s state and federal courts, and I’ve argued complex motions and appeals. I know the exhilaration of a hard-fought trial, but I also know the risks, the costs, and the emotional toll it takes on everyone involved.
Why Mediation?
That’s why I believe that cases only should proceed to trial after the parties have made a genuine effort to resolve their dispute. Trial is one of the greatest dispute resolution mechanisms ever invented, but it should be the last resort. Mediation provides an opportunity to step back, identify common ground, and move toward a resolution that makes sense for everyone. As a mediator, I help parties break through impasses, uncover their real interests, and work toward solutions that might not be obvious in the heat of a legal battle.
Types of Cases I Mediate
During my three decades in the legal field, I have seen just about every type of civil case. As a result, I mediate a wide range of civil disputes, including motor vehicle, employment, professional negligence, civil rights, landlord-tenant, discrimination, premises liability, and physical and sexual abuse.
Where and How I Mediate
I prefer to receive case submissions several days before mediation and typically speak with the attorneys ahead of time to ensure a productive mediation. My goal is always the same: to create an environment where meaningful conversations can happen and where the parties can make an informed decision on whether to resolve their case or move forward to trial. I believe that mindfulness skills like active listening can help to create that environment.
I offer mediation in person anywhere in Oregon or via Zoom, providing flexibility for all parties.
Fees
- Half-day mediation – $1,500
- Full-day mediation – $3,000
- Additional time – $400 per hour
Unless otherwise agreed, fees are divided equally among all parties.
